Terms of Use

These Terms of Use (hereinafter — the "Agreement") govern the relationship between Individual Entrepreneur Andrey Kuzarev (hereinafter — the "Operator") and the Internet user (hereinafter — the "User") arising from the use of the website https://amsim.club (hereinafter — the "Website"). The Website is a sim-racing community platform of Apex Motors Sim Club (AMSC), designed for displaying race results, statistics, event management, and distribution of game modifications. Use of the Website constitutes full and unconditional acceptance of this Agreement by the User.

Registration on the Website is carried out through authorization via the Steam platform (Valve Corporation). Completing authorization through Steam with the consent checkbox constitutes acceptance of this Agreement and the Privacy Policy. The User confirms that they are at least 12 (twelve) years of age at the time of registration.

The User agrees to: • Use the Website in accordance with its intended purpose and the applicable legislation of the Russian Federation. • Not upload malicious, illegal, or content infringing on third-party rights. • Comply with AMSC community rules. • Be responsible for the content of uploaded modifications and other materials. • Not take actions aimed at disrupting the Website's operation. The User has the right to: • Use the available functionality of the Website. • Upload game modifications in accordance with established procedures. • Participate in AMSC events and championships. • Contact the Operator regarding Website-related matters.

The Operator agrees to: • Ensure Website availability within existing technical capabilities. • Process personal data in accordance with the Privacy Policy. The Operator has the right to: • Moderate content uploaded by Users. • Restrict or terminate User access to the Website for violations of this Agreement. • Modify Website functionality without prior notice to Users. • Suspend Website operation for maintenance.

Website content (design, source code, text, graphic elements) is the intellectual property of the Operator and is protected by the legislation of the Russian Federation. Game modifications uploaded by Users remain the intellectual property of their authors. By uploading a modification to the Website, the User grants the Operator a non-exclusive, royalty-free license to distribute the modification through the Website for the duration of its placement.

The Website is provided on an "as is" basis. The Operator does not guarantee uninterrupted and error-free operation of the Website. The Operator is not liable for: • The functionality and content of game modifications uploaded by Users. • Actions or inactions of third parties (including Steam / Valve Corporation). • Losses arising from the use or inability to use the Website. • Temporary unavailability of the Website due to technical reasons.

All disputes arising from this Agreement shall be resolved through negotiation. If it is impossible to settle a dispute out of court, the User may send a claim to the Operator's email address: info@amsim.club. The claim review period is 30 (thirty) calendar days. If it is impossible to resolve the dispute through claims, the dispute shall be considered in court at the Operator's location in accordance with the legislation of the Russian Federation.

The Operator has the right to change the terms of this Agreement at any time. The current version of the Agreement is available at: https://amsim.club/terms. Continued use of the Website after changes constitutes the User's acceptance of the new version of the Agreement. If any provision of this Agreement is found to be invalid, the remaining provisions shall continue to be in full force and effect.
